Pornography Case: Bombay High Court refuses interim relief to Raj Kundra till prosecution is heard?

Raj Kundra's judicial custody has been extended by another 14 days after his second court hearing held on July 27 in an alleged pornography case. The Bombay High Court will be hearing Raj's bail plea today. According to reports, the court has asked the investigating officer to remain present during the hearing. 

As per a media agency's report, the court has reportedly decided not to give interim relief to Raj without first hearing the prosecution. Reportedly, Justice A S Gadkari has directed the police to file its affidavit by July 29 in response to a petition submitted by Raj that challenges his arrest in the alleged pornography case.

According to a report, Raj's lawyers Abad Ponda and Subhash Jadhav argued in the High Court on Tuesday that the Mumbai Police failed to follow the procedure laid down in law and ought to have first issued a notice under section 41A of the CrPC instead of arresting him directly. Reportedly, public prosecutor, Aruna Kamat Pai, denied the claim and informed the High Court that a notice was issued to Raj, who is actress Shilpa Shetty's husband, before arresting him. 

The report stated that the High Court instructed Aruna Kamat Pai to file an affidavit in response to the petition. Reportedly, Abad Ponda then sought some interim relief for his client. However, Justice Gadkari refused to grant any relief to Raj without giving a chance to the prosecution first to respond to the petition.
