Magistrate court calls Raj Kundra's offence 'detrimental to the health of our society', rejects bail plea?

Businessman Raj Kundra and Ryan Thorpe, the IT head of his company, were denied bail in an alleged pornography case. A magistrate court reportedly denied bail saying the charge that Raj and Ryan have been booked under is "detrimental" to society's health. According to reports, the court said under such circumstances, societal interest in the prosecution of a crime cannot be overlooked.

According to a leading daily's report, the court said, "One of the considerations for refusing or granting bail is the nature of offence and gravity of offence. The effect of alleged offence is having nexus with public at large. The alleged offence is also detrimental to the health of our society."

Reportedly, the court highlighted that there were allegations that Raj and Ryan deleted some incriminating data, and there is a possibility that the accused could tamper with the evidence if released on bail. According to the report, the court rejected Raj's argument that his judicial custody wasn't as per law. "The investigating officer has already mentioned the reasons for arrest of both the accused. In such circumstances, it cannot be said that the accused are entitled for bail on the ground that their arrest is illegal," additional chief metropolitan magistrate SB Bhajipale told the daily.

The court reportedly observed that Raj's brother-in-law Pradeep Bakshi, was absconding. "No doubt both accused are in judicial custody. However, taking the accused in judicial custody by refusing police custody does not mean that the investigation is completed," the court said.

The court reportedly pointed out that the investigators had gathered a lot of data and the process of analysis was still going on. "Investigation is in progress. At this stage, release of the accused will definitely hamper investigation. Considering the facts and circumstances, both the bail applications are rejected," the court stated.
