Relief for Mukesh Bhatt: Delhi High court restrains T-Series from using 'Aashiqui' title

'Aashiqui', 'Tu Hi Aashiqui' and 'Tu Hi Aashiqui Hai'...using these types of titles can now prove costly for anyone. This is not our decision, but the Delhi High Court's decision. In this order, at present T-Series has been stopped from using these titles. Actually, the matter is that producer Mukesh Bhatt had approached the court regarding these titles. Now Delhi High Court has ruled in favour of the manufacturer.

This decision of the Court has come amid the dispute over intellectual property rights regarding the use of 'Aashiqui' brand. Actually, the matter is that both Mukesh Bhatt's Vishesh Films Private Limited company and T-Series' Super Cassettes Industries Limited planned to make the third instalment of the 'Aashiqui' series. But, controversy arose when T-Series announced the film with titles like 'Tu Hi Aashiqui' and 'Tu Hi Aashiqui Hai'. Mukesh Bhatt approached the court against T-Series regarding this.

Mukesh Bhatt claims that the title 'Aashiqui' with which T-Series has announced the film could be misleading. It is known that both the films of 'Aashiqui' franchise released in 1990 and 2013 were made in partnership and with joint credits. Now there is controversy regarding the third instalment. The court's decision has come regarding this only. According to news agency ANI, Justice Sanjeev Narula has said in the judgement that the title 'Aashiqui' is not just a one-time example, but is part of a well-established film series, which enjoyed huge success in the 1990s and 2013.

Super Cassettes Industries Limited (T-Series) assumes joint ownership of the 'Aashiqui' franchise, but denies any plans to produce a new installment based on 'Aashiqui' and 'Aashiqui 2'. T-Series argues that their proposed titles, 'Tu Hi Aashiqui' and 'Tu Hi Aashiqui Hai' are separate from Mukesh Bhatt's company and are not sequels. He further said that his film will be completely different from the 'Aashiqui' franchise, which will have no relation to the previous films. Meanwhile, Mukesh Bhatt's Vishesh Films Pvt Ltd has claimed that T-Series is infringing on their proprietary rights of the 'Aashiqui' franchise despite their joint ownership under previous agreements.
