What's the first brand that pops in your mind when we say 'shoes'? Loubotin's, of course! The brand famous for its red soles and sky-high heels, besides its sky-rocketing price, is currently in court trying to protect what they're famous for - Red Soles. The soles which became famous after the ace designer borrowed a red nail polish bottle from his assistant and painted the soles of his shoes red.
It all began when when Mr. Christian Louboutin went to court to prevent VanHaren, a retail Dutch company (a brand endorsed by Halle Berry) who have been selling reasonably priced heels with the same red soles.
If you thought this battle was never waged before, scratch that thought, cause as history goes, Louboutin had earlier filed a lawsuit against Yves Saint Laurent, as well, for selling shoes with a red sole.
These high-end shoes worn by the who's who of the industry, not just in B-town, but all over the world are facing a serious setback with this case. The European Court of Justice’s advocate general Maciej Szpunar said, "The combination of a colour and a shape may be refused trademark protection."
The brand whose shoes cost a whopping 500$ upwards, will receive a serious below if they lose this lawsuit, over their right to trademark their 'red soles'.
